This website is operated by BarelyThere®. Throughout the site, the terms “we”, “us” and “our” refer to BarelyThere®.

BarelyThere® is a trading name of Syreeta Wheeler-Downey.

These Terms of Service apply to your use of www.barelythere.uk and to purchases made through our online store. By placing an order with us, you agree to these Terms together with our Return & Refund Policy, Shipping Policy and Privacy Policy.

Nothing in these Terms affects your statutory rights as a consumer.

Our products

BarelyThere® currently offers physical food products, including Wildcrafted Sea Moss Gel, and digital products, including Food That Brings You Back – Digital Recipe Ebook.

We take reasonable care to ensure that product descriptions, images, prices and other information on our website are accurate. Because our Sea Moss Gel is prepared using natural ingredients, minor variations in colour, texture or appearance may occur between batches.

Product availability may change. If we are unable to fulfil an order after it has been placed, we will contact you and provide an appropriate refund for any affected item.

Food and wellness information

Information provided on the BarelyThere® website, within our digital products or alongside our food products is intended for general food, lifestyle and wellness information only. It is not medical advice and should not be used as a substitute for advice from an appropriately qualified healthcare professional.

Individual nutritional needs and circumstances vary. If you have a medical condition, take medication, are pregnant or breastfeeding, have food allergies or sensitivities, or are unsure whether an ingredient is appropriate for you, you should seek appropriate professional advice before using the product.

We do not guarantee any particular health or wellness outcome from consuming our products.

Orders

When you submit an order, you are offering to purchase the selected products at the price shown and subject to these Terms.

You are responsible for providing complete and accurate order, billing, delivery and contact information. Please check your order carefully before submitting it.

We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, there has been an obvious pricing or listing error, payment cannot be authorised, fraud is reasonably suspected, or we are unable to deliver to the address provided.

If we cancel an order after payment has been taken, the affected amount will be refunded.

Prices and payment

Prices are displayed in pounds sterling (GBP).

Any applicable delivery charge will be shown before you complete checkout. You will have an opportunity to review the total cost of your order before payment.

Payment is processed using the payment methods made available at checkout. Your order may be subject to payment-provider security and fraud-prevention checks.

Wildcrafted Sea Moss Gel

BarelyThere® Wildcrafted Sea Moss Gel is a fresh, chilled and perishable food product.

Please follow the storage instructions provided on the product label. Once your order has been successfully delivered, you should refrigerate the Sea Moss Gel promptly and handle it in accordance with those instructions.

We cannot be responsible for deterioration occurring after successful delivery as a result of storage or handling contrary to the instructions supplied with the product. This does not affect your rights where goods were faulty, damaged, unsafe or otherwise not of satisfactory quality when supplied.

Details relating to damaged, faulty or incorrectly supplied products are set out in our Return & Refund Policy.

Due to the fresh and perishable nature of Sea Moss Gel, we do not accept change-of-mind returns or refunds based solely on personal taste, texture or preference. This does not affect your statutory rights in relation to faulty, damaged, misdescribed or otherwise unsatisfactory goods.

Digital products

Food That Brings You Back – Digital Recipe Ebook is supplied electronically as a downloadable PDF.

The ebook is licensed to you for your own personal, non-commercial use. Purchasing the ebook does not transfer ownership of BarelyThere® intellectual property to you.

You may download and store your purchased copy for personal use. You must not reproduce, resell, redistribute, upload, share, publish or otherwise make the ebook or substantial parts of it available to others without our prior written permission.

When you choose to receive digital content immediately, we will separately ask you to expressly agree to immediate supply and acknowledge the effect this has on your statutory cancellation right before the download is supplied.

If digital content is faulty, inaccessible or does not conform to its description, please contact us so that we can provide the remedy to which you are legally entitled.

Delivery

Physical orders are delivered in accordance with our Shipping Policy.

Delivery dates or transit times provided on our website are estimates unless we expressly state otherwise. Events outside our reasonable control, including carrier disruption, severe weather and other transport delays, can occasionally affect delivery.

Because Sea Moss Gel is a chilled product, we use delivery and packaging arrangements intended to protect the product during transit.

Customers within an eligible local-delivery area may also be offered Local Delivery at checkout. Eligibility and applicable charges are determined using the delivery address entered during checkout.

Cancellations, returns and refunds

Your rights and our procedures for cancellations, refunds, physical perishable goods and digital products are explained in our Return & Refund Policy.

Because our products include both perishable food and immediately supplied digital content, different cancellation rules may apply depending on the product purchased.

Nothing in these Terms or our Return & Refund Policy limits your statutory rights where goods or digital content are faulty, misdescribed or otherwise do not meet the standards required by law.

Intellectual property

The BarelyThere® name, logo, branding, website content, written material, photographs, graphics, recipes, digital products and other original content are owned by or licensed to BarelyThere®, except where otherwise stated.

BarelyThere® is a registered trade mark.

You may view our website and purchased content for your own lawful personal use. You may not copy, reproduce, modify, distribute, commercially exploit or create derivative commercial products from our intellectual property without prior written permission.

Website use

You agree not to misuse this website or knowingly interfere with its operation or security.

You must not use our website for unlawful or fraudulent purposes, attempt to gain unauthorised access to the website or associated systems, knowingly introduce malicious software, or use automated methods to extract substantial amounts of website content without permission.
